Medication Errors
Medication errors cause at least one death per day in the United States and injure almost 1.3 million people every year. Medication errors can be mistakes made by physicians or nurses in prescribing or administering medication. Sometimes, too much medication is prescribed, sometimes too little. Medication errors may also be made at other stages such as prescribing, repackaging, dispensing, or monitoring.
Medication errors are often caused by factors such as poor communication, vagueness of product names, directions for use, medical abbreviations, poor writing, procedures or techniques.
A manufacturer generally will not be liable for a patient's injuries, as long as it adequately informed the doctor of all risks involved with a particular drug. If the manufacturer fails to warn a doctor of such risks, the manufacturer might be held liable for the failure to provide adequate warnings.
In most cases, because of the assumption that a doctor has superior medical knowledge and that she has been properly informed by the manufacturer, she is in the best position to determine whether a particular drug or device is appropriate for a patient. Thus, the physician has the primary duty of advising the patient of the risks and side effects of a medication she prescribes.
